Last Will and Testament of John Henshey Deceased

In the Name of God Amen. I John Henshey of Antis Township, Blair County, Penna. 
considering the uncertainty of mortal life, and being of sound mind and memory 
for which I feel thankful to my Creator, do make and publish this my last will 
and Testament in the manner & form following to wit. 

1st That all my just debts as shall be by me owing at my death together with my 
funeral expenses and all charges touching the proving of or otherwise concerning 
this my will shall in the first place be fully paid & satisfied out of my estate 
and effects. 

2nd I will and bequeath to my trusty son Samuel Henshey my remaining farm lying 
on the head water of the Little Juniatta River in Twp. and County above named 
adjoining Land of John Bell on the East David Henshey on the South John Bell on 
the West and David Cryder Decd. on the North. Containing containing one hundred 
and ten acres more or less on the following conditions to wit. He shall pay 
twenty Dol. For every acre contained therein, the usual allowance for roads as 
excepted. He shall pay the one half of the whole amount in hand one year after 
my death deducting therefrom Four hundred dollars as are exclusive allowance by 
me granted to him for his own use. The bal. Of this the first payment one year 
after my death, yet remaining shall imediately be divided among my following 
heirs, to wit.

To Thos. Donally and Jane his wife Thirty-six Dol.                       $ 36
To Widow Mary Birdsfoot One hundred and fifty-four Dol.                   154
To John Camel & Barbara his wife One hundred and five Dol.                105
To John Kratzer & Elizabeth his wife One hundred and fifty-four Dol.      154
To John Henshey's Heirs (John & Samuel) each seventy one Dol. And 
Fifty cents Being the amount of their deceased Father which is to remain  143
In the place until they are of age.                         

The above sums will equalize them all with my son David who received from me at 
sundry times the amount of Three hundred & thirty eight Dollars. Reference being 
had to my book of accounts kept in the German handwriting will give sufficient 
satisfaction to all who are concerned. Should the first payment not reach to pay 
the above sums together with just debts, in that case there shall be added to 
the latter payments as they become due as much as will suffice. But if there is 
a bal. left of the first payment it shall be added to the latter ones and the 
whole sum yet remaining shall be equally divided among my seven heirs as they 
are in order below, in full, as the payments will become due for the other half 
of the whole amount which shall be paid in payments of One hundred and fifty 
dollars a year. 

1st To Thomas Donally in full of said dividend
2nd To Mary Birdsfoot in full  "    "   "
3rd To John Camel & Barbara his wife in full "
4th To David Henshey my son in full
5th To John Kratzer & Elizabeth his wife in Full "
6th To John & Samuel Henshey heirs of John Henshey decd.
7th To Samuel Henshey to whom I willed the Farm and in case my son Samuel does 
not accept my bequest of the farm on the above conditions then it shall be sold 
at public sale one year after my decease to the highest bidder, and after all 
just claims against me, and the equalization sums above. Together with the four 
hundred dollars to my son Samuel are paid out of the first proceeds of the sale, 
the remaining balance shall then be equally divided and paid over to my seven 
heirs in the order last stated. And last, I constitute and appoint my two sons 
David and Samuel Henshey who are herein before named my only Executors of this 
my only Last Will and Testament. 

In Witness Whereof. I have hereunto set my hand and seal this Twentyeth day of 
June one thousand eight hundred & forty-eight.

Before me the Register for the Probate of Wills and granting Letters of 
Administration in and for said County personally appeared John Aurandt Esq.& 
Robert R. Rhule who being duly sworn according to law do say that they were 
personally present and saw and heard the within named John Henshey sign, seal 
execute publish pronounce and declare the within named John Henshey sign seal 
execute publish pronounce and declare the within instrument of writing as and 
for his Last Will and Testament, and that they did sign their names thereto as 
witnesses in the presence of each other, and in the presence of the said 
testator and at his instance and request, and that he was at the time of signing 
the same of sound and disposing mind memory and understanding to the best of 
their knowledge and belief.

Memorandum. Letters testamentory were this day issued to Samuel Henshey and 
David Henshey on the estate of John Henshey, Deceased. Inventory to be exhibited 
in thirty days from this date and a just and true account calculation and 
reckoning of their said administration of the estate within one year from the 
date hereof or when thereunto legally required. Given under seal of office at 
Hollidaysburgh this 25th day of January A. D. 1856 Account passed and filed the 
11th day of March A. D. 1858, and certified to the O. Court to April Term A. D. 
1858  (Fees $6.50 Paid)
