Last Will and Testament of Thomas Donnally Dec'd.

In the Name of God Amen. I Thomas Donnally, of the Township of Catharine, in 
the county of Blair, and State of Pennsylvania Growing weaker in bodily 
strength But of sound mind memory and understanding and considering the 
uncertainty of this Transitory life, do make and publish this my last will 
and Testament, in manner and form following, to wit. 

1st It is my will and I do order that all my just debts and Funeral expenses 
be duly paid and satisfied, as soon as conveniently can be after my decease.

2nd I give all my Personal and Real Estate into the hands of my Executors, 
here after named, to carry on the Farming and Husbandry of the same to the 
best of their ability, and apply the proceeds there of for the comfortable 
support, maintainance Raising and educating of our minor children until our 
youngest child shall be twenty-one years of age. 

3rd It is my wish that an inventory and appraisement of all my personal 
property be taken and made as soon as conveniently can be after my decease, 
and so much there of sold at public sale as may Reasonably be spared, without 
doing any injury to the Farming Department and raising of Stock.

4th If any of our children, as they become of age may wish to begin the world 
for themselves, It is my wish that my Executors may assist each of them to 
such an amount as may Reasonably be spared, not to interfere with the support 
& education of our minor children and to providing the same amount to each as 
they become of age.

5th When our youngest child arrives at the age of twenty-one years, It is my 
will that all my personal property then remaining be appraised and sold to 
the best advantage. I also at the same time wish a just valuation to be put 
upon my real estate, and if one or more of my sons desire to take the same at 
this valuation, it shall be granted him or them. But if none of them will so 
take it, Then the same shall also be sold as soon as conveniently can be to 
the best interest of all interested, and Two thirds of the amount of the 
proceeds of Real and personal Estate be divided among our children as 
follows. Each son have double that of a daughter and each Daughter half the 
amount of a son.

6th The remaining one third of the sums of Personal and Real Estate shall pay 
interest and the whole principle be a lien on the Real Estate during the life 
of my beloved wife Jane, The above interest shall be paid over to her yearly 
for her support during her life, and as soon as may be after her decease, The 
whole third as above shall be equally divided among our heirs share & share 
alike. 

7th If any of our children should die, and leave us child or children, Then 
his or her share not being paid over shall be equally divided among his or 
her brothers & sisters. 

And lastly I nominate constitute and appoint my said wife, and my Brother 
John Donnally to be the Executors of this my Will. Declaring this and no 
other to be my only and last Will and Testament.

In Witness Whereof, I have hereunto set my hand and seal this Twenty-fifth 
day of August one thousand eight hundred and fifty-one.

Before me the Register for the Probate of Wills and granting letters of 
Administration in and for said County personally appeared John Aurandt, and 
James B. Carothers, who being duly sworn according to law, do depose and say 
that they were personally present and did see & hear the within and before 
named Thomas Donnally, sign, seal, execute, publish, pronounce and declare 
the foregoing instrument of writing, as and for his last will and Testament, 
and that they these deponents, did sign their names thereto as witnesses in 
the presence of each other, and in the presence of the said Testator and at 
his insistence and request, and that at the time of signing the same the said 
Testator was of sound and disposing mind necessary and understanding to the 
best of their knowledge and belief. 

Sworn and Subscribed before me this 19th day of November A. D. 1851.

Memorandum Letters Testamentory this day issued to Mrs. Jane Donnally and 
John Donnally, on the estate of Thomas Donnally, deceased, Inventory to be 
exhibited in thirty days from this date and a just and true account 
calculation and reckoning of their administration of said estate within one 
year from the date hereof or whence the executors legally required. Given 
under seal of office this 19th day of November A. D. 1851. Inventory filed 
the 15th day of December A. D. 1851.
