Will of James Dively, late of Claysburg, Deceased
In the name of God, amen, I, James Dively of Claysburg County of Blair and State
of Pennsylvania, being of sound mind and memory do hereby make publish and
declare this to be my last will and testament in manner and form following,
hereby revoking any will or wills heretofore made by me.
First: I direct that all my just debts, funeral expenses and charges of proving
this my will be in the first place fully paid and satisfied, and after payment
thereof and every part thereof, then I give and bequeath to my beloved wife
Sarah Dively all my personal property that may be in my possession at the time
of my death, together with all notes made payable to me, all ready money if any,
the same to [be] kept and used by her for her support during her lifetime. I
also give and bequeath unto my beloved wife, my house and lot situate in
Claysburg County and state aforesaid as a residence for her, and further I
direct that should she become in needy circumstances, she can sell or use my
real estate to the best possible advantage for her support during her lifetime.
And I do hereby nominate constitute and appoint my wife Sarah Dively Executrix
of this my last will hereby revoking and making void all former wills by me at
any time heretofore made, and declare this only to be my last will and
testament.
In witness whereof I the said James Dively have to this my last will set my hand
and seal this 27" day of May A.D. 1896.

Signed Sealed published and declared by the above James Dively to be his last
will and testament in the presence of us who at his request and in his presence
have subscribed our names as witnesses thereto.

This 20" day of December A.D. 1897 before me, W.H. Irwin Register for the
Probate of wills and granting Letters of Administration in and for the County of
Blair Personally came P.W. Burket and Jacob Carn the subscribing witnesses to
the above will and being duly sworn according to law, did depose and say they
were personally present and saw and heard James Dively the testator, sign, seal,
publish, pronounce and declare the foregoing instrument of writing as and for
his testament and last will that they signed their names in the presence and at
the request of the said testator and in the presence of each other and that at
the time of so doing he the said testator was of perfect and sound mind, memory
and understanding to the best of their knowledge and belief.

Before me the Register for the Probate of wills and granting Letters of
Administration in and for the County of Blair personally came Sarah Dively who
being duly sworn does depose and say that as executrix of the last will and
testament of James Dively deceased she will well and truly administer the goods
and chattels, rights and credits of said deceased according to law, and also
will diligently comply with the provisions of the law relating to collateral
inheritances.

Memorandum: Died December 2" 1897. Proof of death filed December 20" 1897.
Letters testamentary on the Estate of James Dively late of Claysburg, deceased,
were on the 20th day of December A.D. 1897, granted to Sarah Dively (widow) of
same place. Will admitted to Probate December 20th A.D. 1897. Witness my hand
and official seal this 20th day of December A.D. 1897.
