In the name of God Amen. I James Patton Sr. of Kittanning Township, Armstrong
County farmer being sick and weak in body but of perfect mind and memory and
knowing the mortality of my body that is appointed for all me to die. I resign
my Soul to God who gave it, and my body to the dust, to be buried in a decent
and respectfull manner, and as touching such worldly substance as God has been
pleased to bless me with, I give and dispose of them in the form and manner
following that is to say after my funeral expenses and just debts are
discharged.
In the first place I give and bequeath unto my beloved wife Mary should she
survive me, all the household and kitchen furniture, two head of cows, her
choice, the Bay mare, saddle and bridle & five head of sheep and to live in the
house we now live in,
and the entire use and control of the farm during her natural life giving to
Mary Ann & Isabella the right to live on the farm and have their support of it
with their mother so long as the remain unmarried
and also that Mary Ann shall have one horse saddle and bridle, and further that
Mary Ann & Isabella shall have one cow and five head of sheep and also their
bed and bedding as claimed by them. Also each one bureau, one set of china and
bedsteads.
And further it is my Will, that whatever grain flour, meat & together with the
grain in the ground and stock not otherwise disposed of to remain for use of
the family the payment of debt
and further it is my my Will that my two sons John and James shall have all my
farming utensils embracing my wagon, plougs, harrow, horse gears & divided
equally between them share and share alike as can be
and my son John shall have my saddle
and further it is my Will that my son James shall have a piece of land off the
old farm adjoining his land sufficient in quanity to make his equal in quantity
to that give to my son John
and it is my Will that after the death of my beloved wife Mary should she
survive me, that my real esate be sold and the proceeds divided among my six
daughters as follows, Should Mary Ann and Isabella remain unmarried, then each
of them remaining single shall have one hundred dollars and the balance to be
divided amongst them share and share alike,
That is to say Mary Ann one share,
Nancy Sturgeon one share,
Margaret Flake one share,
Elizabeth Jane Moore one share,
Matilda McNeal one share and
Isabella one share,
and I so hereby constitue and appoint my sons John M. Patton and James Patton
Executors of this my Last Will and Testament hereby authorizing and empowering
them to sell and convey my Real Estate aforesaid hereby revoking and annulling
all former Wills made by me.
In witness whereof I have hereunto set my hand and seal this eleventh day of
June in the year of our Lord one thousand eight hundred and fifty seven.
Signed Sealed and pronounced as my Last Will and Testament in presence of
Robert McIntosh, L.H. Allison

Before me William Miller Registor for the Probate of Wills and granting Letters
of Administration & personally appeared L.H. Allison & Robert McIntosh the
subscribing witnesses to the foregoing Will, who being sworn according to law
says that the foregoring Will as & for his last Will & Testament and at the
time of so doing he the said Testator was of perfect sound mind, memory and
understanding to the best of their knowledge observation & belief.
