BEAVER COUNTY, PENNSYLVANIA - WILL BOOK "E"

New Brighton Beaver Co., Pennsylvania Last Will and Testament of Talbot
Townsend Entered April 8, 1869 (Will Book E-138)

     I Talbot Townsend of the Borough of New Brighton in the County of
Beaver and State of Pennsylvania being of infirm health of body but of
sound mind and memory do make ordain and publish this my last will and
testament and do hereby revoke and and make void all former wills by me
at any time heretofore made.
     First after all my lawful debts are paid and discharged the residue
of my estate real and personal, I give bequeath and dispose of as
follows to wit. To my wife should she survive me, all my real estate
wherever situate for and living her natural life, together with such
portion or all of my household furniture and effects as she may desire.
Provided that should my executors herein after named desire it expedient
and my said wife consent thereto the real estate or any portion thereof
may be disposed of and the proceeds there of securely invested and so
remain during her natural life, the interest accruing therein for that
period to be annually paid to her and at her death or as soon thereafter
as expedient the said investment together with all the rest and residue
and remainder of my estate real and personal to be converted into ready
money and divided and distributed amongst my children or their heirs
share and share alike as follows viz.  To my son James Dallas Townsend
by a former wife or his heirs one seventh part - To my son Milo A
Townsend or his heirs one seventh part - To my daughter Eliza Ann
intermarried with John Gammel or her heirs one seventh part
     To my son Milton Townsend or his heirs one seventh part  To my
daughter Caroline intermarried with Ebenezer Rhodes or her heirs one
seventh part.
     To my daughter Lydia Ann intermarried with Edwin Morlan or her
heirs one seventh part and
     To my daughter Alice Ann intermarried with Samuel Junkins or her
heirs one seventh part thereof - Secondly I do hereby constitute and
appoint my son Milo A. Townsend and Edward Hoops (sic) my executor to
this my last Will with ------- and authority to make sale of real estate
and make titles for the same as fully as myself might or could if living
and to do and perform all other acts and things necessary to carry out
the provisions thereof.  On testimony whereof I have here unto set my
hand and seal the fourteenth day of December in the year AD eighteen
hundred and sixty one.

Whereas I Talbot Townsend of the borough of New Brighton in the county
of of (sic) Beaver and State of Penn having made my last will and
testament in writing

in and by which I have given my daughter Lydia Ann intermarried with
Edwin Morlan and to her heirs the one seventh part of my estate as
therein said will provided now therefore I do by this my writing, which
I declare to be a codicil to my said last will and testament and to be
taken as a part there of order and declare that my will is that the said
one seventh share of my estate that would be pay able as in said will
provided shall be invested by any said Executor in some safe and
suitable manner as in a home stead for her own use during her natural
life or in other securities mortgages stock etc. and the annual income
there to be paid to her during natural life as aforesaid and in either
of the two modes of investments mentioned the said portion of the said
Lydia Ann is to be paid at her decease to her husband further I do
hereby nominate and appoint my son Milton Townsend as an additional
Executor and to act in conjunction with those already named in said will
as such.
     In -------- whereof I have hereunto subscribed my name and affixed
my seal this seventh day of January AD one thousand eight hundred and
sixty three

     I Talbot Townsend of the borough of New Brighton County of Beaver
and state of Pennsylvania being of sound mind memory and understanding
do make and publish this codicil to be added to my last will and
testament date ____ day of _____ AD 18__ now in the hands of RE Hoopes
in manner following to wit  I give and bequeath to Elizabeth Townsend
wife of my son Milo A. Townsend the sum of one hundred dollars to be
paid by my executor out of any estate  - In witness whereof I have
hereunto set my hand and seal this fifth day of March AD one thousand
eight hundred and sixty nine.
Signed seals published and declared by the said Talbot Townsend as and
for a codicil to his last will and testament in the presence of us who
in his presence and in the presence of each other have at his request
subscribed our names as witnesses thereto.
